"Losing in court" is not the same thing as complying with court orders. See the decision in Worcester v. Georgia, 31 U.S. 515 (1832), unenforced. If Trump decides to declare martial law, he won't care what the courts have to say about it. Or allow the courts to remain open if they do challenge him.
