that is what the attorneys in the federal court case have done, filed papers to alert the court that Musk's personal lawyers told a court in Delaware that Musk is in charge of DGE. This notification now is in the DC court file, part of the record of the case. The court can use this info to decide.

The practices in France are a bit looser than in the United States. Judges in the United States generally can only decide based on the record filed with the court in the case. They do not decide based on newspaper reports or remarks by other judges. Hearings are transcribed verbatim, not summarized.
