Like, as a hypothetical, you could refuse to train fighter pilots that are left handed, which is discrimination, but on the 'rational basis' that all the fighter aircraft have the controls laid out for right handers and it's not justified to convert them, it's a low bar that they can't meet

Some or even most PEOPLE IN GENERAL should not be in the military. The military is already perfectly good at figuring that out. That's the takeaway: if there were some inherent disqualifying property of trans people, they wouldn't NEED a ban; they'd already fail the normal tests.

I'm giving it the charitable read and assuming she meant making a legal argument and, as someone said, "playing the game."

I wish she had phrased it differently, but I didn't take it to be a "bring this back before on different grounds and I'll grant it" comment, which judges will sometimes make.
