Question for immigration practitioners: say ICE and the administration, being sloppy, thought Khalil only had a student visa when they came to arrest him, and only learned then he had a green card. Would that impact the legality of the arrest? Did they need judicial pre-approval? /1

Mahmoud Khalil showcases an ugly thing about America: freedom of speech (and religion) poll very well in the abstract but if you probe with specific examples of things people don’t like the support falls through the floor. The default is “freedom for things I agree with, for the rest, the lash.”

Hey remember when people said “we need a domestic terrorism statute” and people like me said “that would be super ripe for abuse for whatever lunatic is in power, would you want Trump to have that power” and you sneered at “slippery slope thinking”? Yeah, I remember, dipshit.

I think the best way to produce a renaissance in American faith is to have Trump buy a Cybertruck and get stuck in it when it bursts into flame. How would you be able to deny God then?

This is a grave and sobering admission: they are not pursuing the “WELL ACTUALLY he broke the law during protests,” they are bragging that they are deporting people for protected speech.

I'm only slightly surprised the US Libertarians have looked at the last several weeks of US Government actions, especially what happened to Mahmoud Khalil and really only FIRE is showing what a problem this is (specifically around Mahmoud Khalil since campus free speech is their bailiwick). The […]

American Jews have been pivotal in the battle for civil and constitutional rights, which makes it particularly cynical and loathsome that their alleged interests would be used as an excuse to attack civil liberties. /1

This country’s founders knew that “treason” was a claim so vulnerable to abuse that they took the trouble to define it narrowly in the constitution: “Treason against the United States, shall consist only in levying War against them, or in adhering to their Enemies, giving them Aid and Comfort.” /1

Betar, Columbia Alumni For Israel: learning about a bunch of fascist and un-American organizations this week. Hope their membership becomes public.

Warning: Fascists believe a very wide array of First Amendment activity is “anti-American.” This will not stop here.

How bad this is depends on how far they are willing to go. Are they willing to fabricate evidence to attack vaccines? My guess would be yes.

A craven and cynical government is pushing universities into censorship, though to be fair some of them didn’t need much of a push.

Lawprof A: Canadians are not humans protected by the constitution or entitled to life, according to this interpretation I reached by reading every third letter of assorted sentences in this new Federalist paper I found on Reddit. So, intellectually and academically speaking, you can kill them? /1

If the legal academy has a norm “you should not criticize someone for committing shoddy, revisionist pseudo-scholarship in defense of evil policy,” then perhaps the norms of the legal academy are not worth preserving or defending. As opposed to, you know, the constitution.

Just to put this out as us American leftys, in all our variety, start to fight each other instead of face the challenges ahead. The whole page applies, and the whole story, but really here is the last words: "If everything is a purity test, we will never pass, and we will never make any […]

As an offshoot of this thread, let’s talk about what happens if federal, state, or local officials text, email, call, or show up at your door wanting to talk to you about what you said about the President. I have a theme, a thesis, a throughline, a leitmotif, which is SHUT YOUR FUCKING MOUTH. /1

This is a First Amendment question combined with a practical question. The answer is as follows. First, the First Amendment protects advocating the moral and practical necessity of breaking the law in the abstract. /1

18F, the federal government’s technology shop, was demolished by Musk’s team shortly after midnight. It was a cost-recoverable org, charging agencies for their expertise, using a consulting model. Its cost to government was negligible, its benefits huge. My team there once saved DoD $500 billion.
