When the President of the United States says he doesn’t know if he should uphold the Constitution, it should be a searing red line for every American. If you let him ignore ANY aspect of the Constitution you embolden him to ignore more of it, including the parts that secure YOUR freedoms & rights.

This is a shockingly mistaken understanding of due process by Stephen Miller. It is likely this misunderstanding that is informing the President’s misunderstanding.

Even *if* you accept Stephen Miller’s (textually, historically, and morally indefensible) claim that undocumented immigrants are not entitled to due process, you’d *still* need due process to ensure that the individuals at issue are, in fact, undocumented. His argument fails even on its own terms.

Let’s re-up this argument: Seeking asylum is not illegal. You are allowed to enter the U.S. anywhere with or without documentation, and at a port of entry or not, and request asylum. Personally, I think it should be front page news for at least a month if a sitting US President is using falsified evidence to try and deny due process to a man who has committed no crime, but that’s just me

Friendly reminder. In the United States, criminals are entitled to due process. Even if you pay hush money rig an election, steal top secret documents, or incite a mob to overthrow the government; no matter how egregious your crimes, you’re entitled to due process.
