I am not sure if it’s a bigger indictment of these “legal scholars” or the state of legal academic publication. But it certainly seems alarming that an alleged premier journal would publish this article and that assessment of our scholarship and merit is publication in such journals.

One massive example of how poorly privatization goes, PG&E in California. Profits over maintenance and infrastructure causing brown and black outs, devastating fires caused by their faulty equipment, and the spread of recent fires because of limits in their grid. Catastrophic failure.
