in reality the guideline is just common sense. You are more likely to need a report for a person who has not been in much trouble before than you are for a recidivist offender.

they aren’t guidelines on sentence. they are guidelines as to when to seek a pre sentence report from probation (a report which can often result in a more severe sentence). totally different things.

they do have ways of investigating crime you know? Informants, text messages etc. If there’s nothing to it then I’m sure they will be suing for false arrest.
