just speculation but my take on the Paul, Weiss stuff is that the firm thinks it's making meaningless commitments or ones that it can control through the way they're implemented, but totally misjudged the meaning of a public capitulation

As someone who had a ton of professional respect for PW, I expected better from them. Profoundly disappointed that they would rather throw the entire profession and the rule of law under the bus than take a stand like Perkins.

This is a judge who is very slowly and very carefully making an impeccable record for appeal - one that shows that the government has been given every conceivable opportunity to make its case. And that's all I have to say about that.

As a young person, I often wondered what sort of wild debauchery the next generation could come up with that would possibly offend me. Never in a million years would I have guessed “pro bono organizational downsizing.”

Between yesterday's hearing about the deportation flights before Judge Boasberg, today's unhinged Trump post attacking him and Roberts's response, and the decision that just came out enjoining Musk and DOGE re USAID, we're about to find out just how big of a constitutional crisis we're in.

This is the terrifying part of the DOJ’s Article II argument, since it really doesn’t depend on citizenship status. Under their interpretation of presidential authority, citizens could be deported without any due process if the government says they’re a national security threat. Beyond chilling.

Shorn of the legalities, the Admin basic position is that we can do whatever we want if we say it's national security (and that includes Trump lies about same, which can't be questioned) and we don't have to tell court or anyone why. That's tyranny, plain and simple.

We are not a serious country.

The argument the administration seems to be settling on – that the planes had gone into international airspace – is ludicrous. If the executive had power to act, the judiciary had power to enjoin. But even setting the merits to the side, it makes it look as if the administration was playing games.

I’m totally fine with deporting gang members who commit crimes who don’t have legal status. I just don’t want Tom Homan or an ICE agent grabbing anyone off the street and flying them to a prison in El Salvador while claiming they are all of those things with zero due process.

On a scale from 1 to “The fury of the burning fire of a thousand suns,” how mad do you think Judge Boasberg will be at Trump and Rubio laughing about defying his court order?

Whether Judge Boasberg was correct on the law is largely irrelevant to whether the government is in contempt for willfully disobeying it. If the Trump administration knew there was an order from a federal judge and then willfully violated it, that is the end of the analysis.

Recall that this court order yesterday should have halted prisoner flights from landing in El Salvador as of the moment it was entered. It appears that order was not followed. All eyes are on how DOJ will explain this failure to comply and what the judge will do.

Well, looks like we’re already here. The Trump administration willfully defied a court order. Hopefully the court will hold the government in contempt. What happens next is going to tell us exactly what direction we are headed

🚨BREAKING: It seems very clear that the Administration decided not to abide by the court's order. The question now is what will the judge do. Does he proceed with contempt or something short of that to defuse. Upping the stakes is the fact that the AG and her senior staff signed this notice.

A federal court’s jurisdiction does *not* stop at the water’s edge. The question is whether the *defendants* are subject to the court order, not *where* the conduct being challenged takes place. Were it otherwise, the government could act lawlessly overseas and courts would be powerless to stop it.

Trump can call me names but the truth remains. He is an unhinged wanna be dictator who is angry that I beat him in court and won't cower in fear. Now he is weaponizing the federal government against his political opponents. I will not back down. I will not bow or scrape. I will never obey.

I think some in the Senate have convinced themselves that the backlash to folding will be limited to “the left” and therefore ignorable. Those people are deeply and profoundly misreading the moment and the stakes. Virtually every swing district House Dem walked the plank to vote NO for a reason.

The institutional Democratic Party is guided by an almost pathological level of conflict avoidance in almost every direction. “What can we do to make the least number of people mad?” is just a bankrupt way to operate.
