But Chris, didn't all black Americans get US birthright citizenship from the 14th Amendment after the civil war? There are so many racists in Trump's group...
I think what ice is doing already is unconstitutional
They’re not giving people a chance in front of an immigration judge
He just wants to put on planes and shipped away
Obviously arresting a US citizen and a veteran
How many are we gonna really find out about?
It’s hard to understand how someone that has parents or grandparents that were immigrants not born in tge usa supports Trump when they can be questioned about their own citizenship
The part I find interesting is the WH group who say that, native Americans herded onto reservations when the amendment was approved were NOT under US jurisdiction. And so, they were NOT citizens, there was no birthright citizenship, and that would extend to each successive generation to this day.
It is little know how far these people are willing to go to purge non-whites from the country. Just reported is a new quota for ICE deportations that will add pressure to arrest BY SKIN COLOR, not status.
I believe MacLeod is Northern Irish and McLeod is Scottish. I have a friend in the USA named MacLeod and his ancestral family is all Northern Irish and another friend from Scotland named McLeod and part of the clan McLeod.
Except their father is (theoretically, I’ve not seen his birth certificate or know if it’s been verified), thus making them American citizens. Unless they’re from Hawaii and brown. Then no. Vance’s kids are a gray area.
So you actually believe the same laws that apply to US apply to the privileged, too? 78 years of walking around fat and free - while helping himself to OUR money - would argue differently.
The law has never applied equally to all levels of society. And then you have lying, sanctimonious bastards like Merrick Garland - trying to assure us that it DOES...
Actually, you have to look at the very narrowly tailored language of the EO. It denies citizenship to children of two non-citizen parents. If the child has a citizen father, they’re good. So Dump’s & Vance’s spawn are cool.
If they reject citizenship based on the 14th amendment, it means people born from illegal immigrants are not subject to the jurisdiction of the US. In other words, if they commit crimes, they can’t be arrested because the US has no jurisdiction over them.
Also... if a president can overturn an amendment with an executive order... what stops a future Dem president from finally allowing states to do something about gun violence?
The legal theory that a president can redefine a constitutional amendment with an executive order would support doing that... states really should consider "trigger laws" to automatically enact sensible gun control upon it becoming legally possible. (similar to what some red states did for abortion)
Birthright citizenship is quite unusual, UK doesn't have it, for example. It was implemented for very good reason, obviously. Changing it should be open to legitimate discussion and debate. Shame a nazi is just being a dick about it.
The USA still has no central registrar of births marriages and deaths and there are still millions of old people born in the country who cannot prove that. Removal of the 14th amendment disenfranchises these people as well as their children.
There is no “legitimate discussion” to be had with these people. Birthright citizenship is unquestionably in the Constitution and the only reason they want to change it is virulent racism.
Completely agree. I have seen peeps stating that birthright citizenship can never be changed. That's not true. If it's going to be changed it should be reasoned debate not fashy arseholes lashing out
Okay now let’s do a post on how the 14th amendment impacts the 2nd one. All these maga yelling to overturn the 14th should know it’s through 14 that the states get 2a.
Do me the favor and deport me. My people were stolen, used as Chattle slaves and had the most ghoulish and gruesome shit happen to us. Then forced to stay. Please send me back once they figure out where we came from. Im working to move abroad and give my citizenship back.
It is entirely about creating a white America. I have been screaming about this being the focus of the Trump campaign and agenda and getting constant push back from women, claiming that misogyny was also a focus. Women are not threatened with deportation.
The overwhelming majority (north of 90%) of crimes committed with firearms in the US are committed with handguns. That's the category of firearms that should be the most heavily regulated.
The majority of those are committed with handguns as well. If you want to reduce the number of firearms deaths in the US, handguns are the most effective target for increased regulation.
If we end "birthright" citizenship, or another way to look at it, anyone who is a 2nd gen immigrant, based off the last numbers I could find that would effect 12% of the US pop or about 37 million people.
Seriously what the fuck is this suppose to accomplish at all besides economic depression?
I’m not sure why lawsuits are necessary. In an instance as blatant as this the SCOTUS should just issue a preemptive judgement stating that as the 14th Amendment is a part of the Constitution it can only be changed through the process outline in Article V. End of conversation. Next.
I’m not sure how it works but with such a blatant attempt to overturn the Constitution it should be the purview of the guardians of the Constitution to weigh in unilaterally so there are no misconceptions as to the robustness of the Constitution. Trump will be launching continuous assaults.
Why post this nonsense? He can’t end a constitutional amendment. Talking about his nonsense is useless yet what he wants you to do. Don’t play the fool.
I think they’re going to try and ram this through under the guise of wartime as an excuse. They’ve already got a judge making that argument. We definitely need to keep an eye on this.
Each day we read of these fascist attempts to undo our democracy & illegal policies based on utter stupidity.
The moron and his monkeys will *undoubtedly* crash the world economy, destroy our alliances and foment war…When the consequences hit MAGA home$, they will realize. Stock up, people.
Chris, this reporting you’ve done is awesome. Thank you for your efforts and explanation. I wanted to know about this and only come to BSky or read https://NPR.org to get my news.
My question: who’s reading the Washington Post anymore? We’ve randomized reader focus I think, don’t you? This must be solved.
So wait how would that work? Is it the "grandfathered in" thing because you grandfather was a citizen you're a citizen or is it like all newborns would be illegal immigrants 🤣
I love politicians making a whore out of logic (not sure if this joke translates)
The proposal is that going forward, your parents would need to be citizens (or I think legal permanent residents) for a child to be a citizen at birth.
So you don't currently have to trace your ancestry back and only the children of illegal immigrants would themselves be illegal.
It's kinda ridiculous given illegal immigration as far as I know is only a tiny % of the population usually in low paying positions anyway.
There's more issue imo with H1B being abused by companies because local talent is "too expensive".
But that's an outsider perspective.
DT's granddad may have been a legal immigrant BUT... he was a Tr*mp
1) he immigrated to escape conscription in the army (forfeiting his home citizenship)
2)he got to grifting ASAP! In addition to his Klondike brothel, he built a big ol' hotel—on land he DID NOT OWN. Everything obv 💯 on the level!
It is highly unlikely this will happen. It would require a constitutional amendment and I'm pretty sure that the Dems and enough of the GOP will tank it.
No. The birthright change would go into effect now. They’re making sure their families are not affected by it. However, in truth, if they don’t want you here, they’ll find a way to get rid of you.
The “crime” here is that the article would lead a relatively uninformed person to believe that the matter is legitimately open to good-faith debate. In the timeline we’re supposed to be on (that we departed on 11/8/16) this is a long-settled matter requiring a constitutional amendment to overturn.
Was reluctant to cancel WaPo subscription bc I felt reporters worked hard, did a good job. Also, as a DC resident, I wanted the paper to survive & not many people can afford to own a paper that loses over $70 million a year. But as of last week, I’m out. The cowardice and complicity can’t be ignored
Look at the bright side. If we end birthright citizenship for everyone accused or found guilty of a crime, we could declare ALL prisoners non-citizens and deport them somewhere. Oh wait. Senators with private prison stock would object. So birthright citizenship likely stays.
Birthright citizenship is YOUR right.
Your right to know, from the day your child is born,
That he, or she, is an American.
Without birthright citizenship, who decides whether your
child is an American citizen?
Congress decides, that's who.
Do you want CONGRESS deciding THAT?
Also, if you want to "address" this, and make everybody carry around their full genealogy to prove their citizenship, there's only one legal way. Amend the Constitution. Go ahead with that. But don't say we can just wave the constitution away, when you think it's "time" to do so.
If he didn’t say for children of illegal aliens it means ALL OF US! My family has been here since the 1600s but if all children born on us soil aren’t citizens we are all illegal
I'm surprised I haven't yet seen opposition framed as "If we can remove the 14th amendment by executive order, what's stopping him from removing the 2nd?"
Or just the ones they don’t like. The 19th, perhaps? How about the 13th and 15th, too? Where does it end, if not here and now.
I shudder to think about kicking those “back to the States.”
For Americans with an ancestor who naturalized in the US, it might be relatively simple. Those with male line ancestry going back to 1789 might have to study colonial and pre-constitutional state citizenship laws.
Why can’t we just have some middle ground? Go after the Coyotes, the Cartel. Leave the third generation working family down the block alone!! I don’t understand.
If this is allowed to go through, he will have free rein to issue executive orders, changing whatever part of the constitution he wants. More so they will morph the laws like they did in Germany to revoke citizensship for anyone they choose is not sufficiently loyal
This is so much scarier than it's being given credit for but at this point what in this coup isn't? So remember we all have little battles to fight too. There are needs beyond war fighters. So many ways to revolt or make your dissatisfaction known. Every tiny bit of hope or help is essential.
My brother, a diehard Florida magat, was born in 1970, our mother became a citizen in 1972. He has birthright citizenship. He wants it ended. Not only would he lose his citizenship, he would automatically lose his job as a sheriffs deputy due to not being a citizen.
That would look like my friend whose parents are not citizens being deported after living all 32 years in US... attending Elementary, High School, UTD, then graduation from UT Southwestern Medical School working as a family practitioner.
2. Why do we still need this? We don't? Yes it will take 2/3 Congress and 3/4 States to change it - PROACTIVELY. My guess is 75-80% agree with changing this.
3. Dems secure DACA citizenship and it could happen.

The words “Fourteenth Amendment” do not appear in the story.
The closest we come is a note that one of the lawsuits is “claiming” that the order is unconstitutional and a mention that it is “likely to face a lengthy legal battle.”
Journalistic malpractice. The authors rec’d their educations at Grinnell, U of MO J-school, and Harvard, respectively. Those well-regarded institutions should consider revoking their degrees.
Constitution is gone from the white house. There were 0 American flags at Capital one arena (see my pinned post), Donny didn't put his hand on the Bible (which i'm not Christian and don't care, but HE IS, so that means something), rights are being stripped left and right.
They talk about a “history of challenging birthright citizenship” in Texas, hiding at the end of the section that the state does not have a history of success in doing so.
The press, loosely and collectively speaking, is so bad at highlighting what’s really important. The Daily Milquetoast is what most of them should be named.
I get the desire to do a story on the potential effects should this order go into effect — and the importance of those dramatic effects to those affected and to the entire country.
This, however, is not the way to do it. Not by a long shot.

And for some reason, that no longer counts.
I've griped about this numerous times.
It's my alt-text of battles here on bsky!

but it also means Vance's wife her children need to be deported.
citizenship ???
And this is a guy appointed by Ronald Reagan.

such as, you can't have weapons of war in your house
handgun, sporting guns for hunting ... sure
In schools. Baby steps.
How many schools shot up by handguns and what was the death toll?
How many schools shot up by weapons of war and that death toll?
The idea of a full scale ban of handguns, sporting rifles and weapons of war is a bridge too far.

Literally.
If you want to absolutely shred the flag and shit all over the Constitution, this is one sure-fire way of doing it.

That is why Obama was always a citizen.
He seems to be an as@#$%le as drumpf...
I said this yesterday in an allergy group who insist 504s/IEPs are untouchable:
“He signed an order to get rid of the 14th amendment, what makes you think he won’t try to get rid of the Rehabilitation Act of 1973?”
I shudder to think about kicking those “back to the States.”
That’s good news for Elon. He’s practically there already.
