Surely, they need to look at revamping SCOTUS. After all you have 50 states supreme courts, you could select the required judges from them randomly, then select 1 final judge by lotto, to be chief justice for the case, constantly changing. No need for presidential selecting justice preferential ones
The part I can't understand is America was supposedly so ashamed of using this w/ Japanese interment camps in the 1940s - They've had 70 YEARS to repeal that horrible law that allowed that. But no group of lawmakers in all that time thought about doing that?? How is that possible?
I hate to 'yeah, but' because YES, this is SO BAD, BUT... from the text of the decision today, this is important:
"It is well established that the Fifth Amendment entitles aliens to due process of law" in the context of removal proceedings (Reno v. Flores, 507 U.S. 292, 306 (1993)
Not to be shitty, but them enshrining in their own decision bluntly 'yes, aliens are still afforded due process' is very important with everything that's going on, including but not limited to the near future when this administration has obviously planned to argue, somehow, that even citizens don't.
This won't be them rug-pulling some 5, 10, 25, 50, 75 year old precedent, this will be them having to disco dance around their own fucking precedent, worded simply and to the point without room to dodge and weave.
"Quickly deport"? No, all nine justices agreed detainees are entitled to notice and a judicial hearing before deportation. A very bad decision coupled with a whole lot of bad reporting today.
I think you must be confused. The Republican majority refused to allow Obama’s nomination of Garland to go ahead, after Scalia died, for nearly a year. Then when RBG died they forced through Barrett’s nomination in a couple of months. There was nothing the democrats could do about it in either case.
If RBG was healthy. I would agree, but she had cancer. She wasn’t in remission or
anything of the sort. Once you have an illness like that the right thing to do is to retire.
Ohhhh there was things they could have done but they didn't take it all the way. But yeah the Republicans werent acting in good faith. They dont want a constitution. They want a fascist regime and the old democrats are little puppies.
When it comes to thuggery and doing what’s wrong, the Dems are no match for the Republicans, even retaliating against them and pushing for what’s their entitlement they folded. 🤦🏽♀️
What a disgrace for the Supreme Court to side with a convicted felon who has destroyed our country, breaks the law on a daily basis, hasn’t upheld his oath which we knew that shit was a lie, hasn’t upheld the constitution and nothing stands in his way now. I truly can’t believe this.
They’ve just delayed the enforcement of the lower courts’ decisions, and have asked for briefs before it issues its own decision. The Supreme Court hasn’t actually decided the issue yet
Tell the Berniebros and Stein voters that helped to elect Trump in the electoral college. We lost THREE SCOTUS seats for the next 30 years. Roe v. Wade. Chevron. And other SCOTUS decisions, just like this.
Well apparently in our crappy system of government 5 people get to decide what the Constitution means. So apparently no laws were enacted to protect people & this decrepit old piece of paper can be used to support any kind of evil. It's trash to me now.
This is how democracy dies. Not with a big bang. Slowly and painfully as one vital institution fails to stop tyranny after another and suddenly there is a power vacuum that invites the mad tyrants and their paramilitaries ready for all kind of atrocities. History rhymes.
The aclu considered this a win too. The court ruled on a technicality sadly. Wrong state basically. But they did pave the way for the aclu to file properly and block when this will eventually happen again. So uh. Silver lining?
SCOTUS simply let it stand until the case was refiled in TX and NY where last night both lower courts rejected the use of the law, so NOW see what SCOTUS says. This is routine, nothing new, about letting issues ride into the proper jurisdiction. Pause before lighting hair.

"We cannot help as we no longer have jurisdiction." 🤷
I care about the PEOPLE that are being disappeared and discarded by these monsters.
Not a single one of us should feel safe in the United States.
We cannot let this go on.

By everything I read, this should
be illigal.
So, this is not the first time the supreme court has ruled contrary to the law.
Sad sad times.😥😥😥
I don’t want to hear about the market until they are home.
I don’t want to hear about the Senate until they are home.
They are all of us.
WHAT BULLSHIT!!
They can’t arrest you nor deport you for staying home.
