As people are trying to understand how courts enforce their orders, this DOJ Org Chart may come in handy. The courts don’t have their own enforcement agency. The US Marshal’s Service is part of DOJ.

that's what Vance was saying, "ignoring court order is one of the admin's choices". it means the beginning of tyranny and 1/3 of the nation supported it. in such case, the only solution is "national divorce", if 2/3 of nation want democracy.
i'm no lawyer but in such a real coup situation, the court might directly request Marshals Service to enforce the law depending on the situation. if admin needs some legitimacy, they will appeal to SCOTUS, but it's not guaranteed.
in such real coup situation, it comes with impeachment against Trump/Bondi by the congress but it's not guaranteed either. if such coup occurs, it simply means rolling back to before civil society, meaning, there were too many morons in the country.
Anything short of inclusive/inviting cogent messaging (we're talking Friday night Lights) is just lowering any semblance of Resistance to cable news level—
Ever notice how cable news acts like a confused referee in a wrestling match?😵💫🤷🏼♂️🤷🏻🤔
Back turned long enough to allow the bad hombre to do some 💩?
And what we won't see is a NYT headline that says: Trump Defies Court Order, Defies Constution. So people understand. Instead they'll say Trump Aggressively Enacts Agenda; Some Democrats Object
Oh, good. Enforcement is in the hands of the DoJ. The same DoJ that says trump and Musk don't have to follow court orders. The same agency that's now headed by a Russian asset that took a bribe from Trump to drop a case against him.
We need to understand that apathy is killing our democracy before our eyes. We must spread the word everywhere. If not us, who? If not now, when? It will only get worse. Support @aclu.org @democracydocket.com @democrats.org for starters. #RESISTNOW
they do have fines for contempt and court orders to freeze all the assets of those involved until the fines are paid... and we'll all kick in to hire a process server
Suppose a few members of the USMS decide to honor their oath to the Constitution and arrest people held in contempt. How do you think that this would play out?
Thank you. Is there any recourse for enforcement as a pledge to uphold the constitution was given by the agents or are we dependent on the DOJ enforcement.
If the Executive ignores judges, the Courts emasculated & MAGA GOP House betrayal of their Constitutional oath, wouldn't States feel free to ignore the Fed? Also, with our Constitution in shreds, why would our Military allow themselves t/b civilian ruled? Is this democracy's beginning of the end?
U.S. Marshals, like other officials, swear an oath to uphold the law. If they fail to carry out their duties, they violate that oath. When will people in positions of authority demonstrate integrity and fulfill their responsibilities?
Oath, shmoath. None of the republicans in congress give a rats ass about that same oath. The president and vice president think it’s a joke. Most of the Supreme Court doesn’t care. Some of them lied to congress before being confirmed and got away with it. The oath means nothing to these infidels.
When the dust settles and the felon, the South African illegal alien and the entire syndicate are all in jail, we need to take a good long look at our three branches of government. Clearly it needs a redesign. Yes I have faith it will happen.
@charliesavage.bsky.social is a man after my own heart - true for decades now, and this now is Exh 1 for why.
Vance is right in the last sentence Charlie quotes: We sure do need to be honest about what's ACTUALLY going on. Charlie is, here - to the extent permitted.
So, in other words- there is no enforcement mechanism since the DOJ is now an arm of the executive branch. How do you suggest these court orders be enforced? People will blame Dems somehow- just wait.
At some point everyone, us marshalls, FBI, military, CIA need to decide if they will continue to obey an unconstitutional order from the president or abide by their duty to the constitution. Let’s just hope there are enough honest people when those orders come.
Please stop. They are playing a tiny game. They tried to quibble and say the memo about two specific fundings wasn't included in the filing and therefore not part of the TRO.
Judge has already said otherwise and they are getting a freebie to correct themselves.
If every branch of government had its own enforcement agency, our government would be in a constant state of civil war. The only real check on the executive branch is “the people”.
Do the U.S. Marshals ultimately report to AG Bondi. What are the chances they’ll be around to enforce any court order? Will Musk eliminate the US Marshals as well? Trump’s paranoia and authoritarian politics are democracy’s death knell unless we stop him. Fight! Fight! Fight!
Napoleon: Crude and brutal, affairs, caused financial crisis that resulted in the Louisiana Purchase, exiled and came back, and fought for social recognition. Standing at the door and letting a guard turn them away is not something Napoleon would do. Ignoring the courts is what he would do
It doesn’t matter. Trump has his henchmen in all agency’s. Where are our fail safes? I do solemnly swear that I will support and defend the Constitution of the United States against all enemies, foreign and domestic. Doesn’t say anything about supporting or defending the president.
We all know the truth. It’s going to take extraordinary measures by we the people to stop Trump. We won’t get the courage until it’s the last remaining option. Isn’t that the way this has always played out in other countries?
I just knew Eric was involved, talk about a terrorist! And the perfect little fighter for the felon. I do hope our federal marshals are up to the task.
Blackwater changed their name to Academi after getting caught committing war crimes. Academi merged with Triple Canopy. The armed guards in DC are wearing the Triple Canopy Insignia.
They provide security for government buildings through federal contracts with the state department or CIA. They CANNOT operate without that government contract. Elon is not authorized to contract them. A government official is. Likely Trump. Meaning your own Commander In Chief has
They should have brought some state national guards, or better yet, 'mercenary' guards with them to show WE Mean Business. Of course Trump would take a Congressman 'hostage' by arresting one, but we can do the same bc if they aren't going by rules, we won't.
Yes I remember that little twerp of a privileged stinking ideology. Eric (blackwater)Prince. He's resurfaced and I'm sure even more dangerous. This more than proves it!
Regular listeners to her #Sistersinlaw podcast or her Cafe Insider podcast with Preet Bharah know that she did. Since 2023. She was more circumspect about it on MSNBC.
And that means once they’ve gutted the civil servants who now work there and replace them with sycophants, there will be no one to call on to administer the rule of law.
Harris conceded the election without any audits knowing the stakes.
And no, I don’t think he won every battleground race.
We now have no checks and balances left.
She gave up her power when she did not challenge any of the results.
When a small group of criminals can easily invade government agencies and steal our nations secrets and information, it’s not a stretch that they also manipulated the votes in key states.
Now we’ll never know.
Impeachment is the remedy to an out of control Executive. If Congress wanted to, they could impeach a slew of these cretins in 24 hours. Throw all the bums right onto the street.
But they don't want to. That's the flaw.
This is going to take mass protests by the people. Sooner than later.
But here we have the trifecta of evil.
Flawed rules of enforcement, and the naive assumption that men of honor would hold the levers of power, have doomed this nation.
If congress & the courts have no enforcement powers, then there never have been real checks & balances, only the goodwill of the monarch the “founders” chose to call a president.
What happens if he is impeached (not going to happen with this congress) and he just refuses to leave? Who is going to force him out? He’s trying to get rid of anyone that’s not personally loyal to him.
I've never heard of it happening. Normally they are the enforcement arm for the courts. But then most of this has never happened. I suspect we're going to find out what happens if/when they obey the AG rather than the judge.
This aligns with the question I asked in a business law class some 15 years ago. I asked, if the president decided to tell the courts to get stuffed, what could they do? The instructor mumbled something about the marshal service but really didn't have an answer. This is why.
We have the power to vote, call our representatives, and protest. I’ve read it goes in cycles. When it swings too far to one side voters bring it back toward center.
Bondi is bought and paid for - like the house of reps - are supposed to be for the people and not the President, Pam Bondi is also the people's AG- She will not serve the people unless it serves Donald Trump -
It is so very corrupt and so incredibly wrong.
Other indirect enforcement mechanisms are also available. Courts can issue sanctions against the party’s attorneys. State bars can take and enforce disciplinary actions against those attorneys. Civil lawsuits are also likely available, which can be enforced through state mechanisms.
It is almost inconceivable that almost all the other branches of government that were designed to be checks and balances have shown to be weak & acquiescing their power to a tyrant
When Mango Mussolini owns, the police, the national guard, military etc etc. The courts doesn't have their own enforcement force. So the courts won't work. Sorry
The Marshals have been helping DOGE. Muskrat's little SOBs called Marshals to drag out staff from USAID offices, I think? One of the places early in their little takeover. They will likely choose Trump over the Courts.
There have been some comments indicating those refusing Congress members to enter agencies blocked by nole ksum are security hired by Blackwater (not sure what the current name is) mercenary corporation.
Marshals who are directed by the DOJ, okay,,, Meanwhile, president Musk and his lilbch Trump are outsourcing ‘security’ to Erik Prince’s minions. Who’s paying these goons to keep elected Congress people out of DOE, EPA, Treasury, etc? What authority do they have?
But should they be a part of the DOJ? I mean, could one say that the Constitution of 1787 might have been a bit more resistant to executive overreach if all constables should be servants / protectors of the Courts?
@raskin.house.gov Please start a class action suit against Trump as you described on The Weekend! Millions of us are waiting for a leader and event that will bring us together in force. This would generate huge energy and could be a beginning of the end - our SOLIDARITY! Please be our Lech Walesa!
Vance has not yet used the word TREASON! And it's up to Raskin and Dem Congressional leaders to get Generals & Admirals to follow/honor their OATH< "...TO DEFEND THE CONSTITUTION AGAINST DOMESTIC ENEMIES..." And this oath takes precedence and controls! The Army is loyal to the Constitution, not king
It means if the administration doesn't enforce the orders, they don't get enforced.
The orders don't go away and the judiciary will create more orders going up the food chain. They will pile up, and contempt of court will happen until they do get enforced.
All take oaths to uphold, protect, & defend the Constitution from all enemies foreign & domestic. Violating a court order is not upholding the Constitution. Courts have jurisdiction over disputes regarding federal law & the executive. If they violate the court order, it is sedition. Full Stop.
..and if it’s Sedition.. who exactly would prosecute THAT and enforce?? I’m assuming that’d be the GQP Congress of spineless simpletons?? Yeah.. we’re fucked!
No. You are correct. It is over. It will be over because of the seditionists. I take that back. I knew it was over the day he was elected. There are no checks and balances.
The DEA has been ignoring a Supreme Court decision to prevent over aggressive arrests of physicians treating patients with clinically needed controlled drugs.
True, but the courts have inherent power to enforce their judgments. Granted, this would be an entirely novel use of that power, but my understanding is that they can deputize anyone, including local police, State AG's, and various alternative sources. Now that could lead to dramatic standoffs.
The question is, would the DOJ, and other official forces act to prevent lawful court orders from being enforced, on the orders of the President. Then we would be in a really serious place. I agree and do anticipate that the President and AG will likely not enforce court orders, first through
false misinterpretation and by way of false and misleading behavior, which they have already tried. But thereafter, once things get serious, I believe they will simply not act. The question then is, will they order federal authorities to obstruct court deputized persons? Then the US Supreme Court
would be asked whether it would uphold the power of the courts to enforce their rulings, or not. They could just claim the rulings were invalid and sidestep the issue entirely, which is a likely tactic. One might hope that Justices Roberts & Amy Coney Barrett might blink. The rest are a lost cause.
If Trump activated the military, to oppose court orders, that would be quite the constitutional crisis. However, since commander in chief is particular to the President, you’d have a challenging situation leading potentially to more than just a constitutional crisis. A court might be able to call
On governors, in theory, but seems unlikely, and given our modern system, it is more likely that should Trump call in the military, we would have to rely on members that would understand the gross illegality of that…
I half heartedly offered my services to make a citizens arrest in another post but if I am understanding you , most any one can be deputized. Or is it just those with police or military training. ?
Law enforcement if they needed to. However, the U.S. Marshalls, though under DOJ and the President, they have direct legal responsibility to carry out the orders of the U.S. Courts.
So if US Marshall's Service is part of DOJ and DOJ is no longer independent.... And the folks in power are lawless.... Well then....
Zero accountability or enforcement? 🤢
The Marshals thing isn't a system the Founders set up. The Constitution only specifies a Supreme Court; everything else is up to Congress and has evolved over time to what we have now. Congress could change it again if they decide to.
The court system should have always had their own enforcement mechanism. Our country is set up too much to trust that people just will follow judges decisions.
Joyce, could you add the year that each branch was created? These institutions respond to societal need, rather than just suddenly appear as an octopus. They mark the advance of civilization.
It would be an impeachable offense for Pam Bondi or Emil Bove to interfere with the U.S. Marshal Service executing a body writ pursuant to a court order. Moreover, it's something that should get them disbarred -- in 5 days, not 5 years. Legal profession is too reluctant & slow to police its own.
Necessity is the mother of invention... lets create a new law enforcement agency specifically tasked with enforcing court orders, separate and above the executive branch as our 'checks & balance'.
Where is the shadow government and can they please hire all the fired Inspectors General? Also, some private security professionals of their own? I hear Blackwater is available for hire.
respectfully (you’re AN ABSOLUTE TREASURE 🤎 )
we sane folks out here SEE NO CONSEQUENCES with all this “they swear to uphold an oath…” 🟰 as did Republican members of Congress 👉🏾 👉🏾 and yet❓
I'm guessing when folks finally reach the conclusion that there isn't a logical, reasonable explanation for what T/Musk are doing to us the 💩 will hit the fan.🤞
The media also needs to remind people that the “Acting Deputy AG”, Emil Bove, is the law partner of Todd Blanche & personal criminal defense lawyer in the trial that resulted in the President becoming a convicted felon.
Of course he is targeting the President’s enemies.
I added a mark-up to the above Organization Chart so people clearly understand a possible big problem with the US Marshals trying to enforce a court order against the administration:
So you’re breaking it to us that no matter what the federal judiciary rules, there’s no enforcement mechanism… and Trump can simply ignore any court order he doesn’t want to comply with?
Even Nixon complied with court orders, it just shows you how far we have fallen since then. Trump and his Dogebags have been eroding the system for nearly a decade now, and this is the result.

The reason Nixon complied with any court orders had nothing to do with his integrity. At that time, most Republicans were still supporting the rule of law and Democracy. Not true today.
Yes,the fact that the GOP threatened to throw Nixon out on his ass (and said they’d impeach if he didn’t resign) shows the striking descent of the party’s integrity.
Way back in those days, a lot of Congress believed in the rule of law. And would stand up for democracy.
Times have changed
That’s sure how he played it during the impeachment trials. They ignored subpoenas and nothing happened to them. Without testimony, it’s really hard to prove your accusation as true. Like you can’t have a pandemic
w/o data.
Sometimes I think we’re finally experiencing the hell we caused Native Americans & Africans. The chickens have indeed come home. We stole this land, and slaughtered and enslaved millions. This is America. It’s just now coming for everyone. Dark. I know.
Wouldn’t it have been so much easier for everyone if enough white folks had just found the courage to actually believe in equality since the civil rights act (at the very least) and decided to be committed to societal change then? POC have died begging y’all to just be decent forever!!
That is untrue! If enough white folks truly believed in equality, we would have abolished the electoral college, passed universal healthcare, banned voter suppression, banned abortion restrictions, reformed the education system, and raised the minimum wage by now, just to name a few!
Not all white people are republicans. Is it helpful to further divide the country and the party with language like this? All Dems should stand together. Leave race out of it.
People who say “we are better than this” uh historically, no we are not. Yeah now sucks for us white folks, but nothing like the hellacious way this country started.
Every civilization, every empire since the beginning of time ended. Perhaps this is just our time. I've moved past the shock and denial, past the deep sadness & feelings of loss and am moving toward whatever is coming. It will be scary and ugly and different from what we've known, but we must fight.
Native Americans stole each others' lands, too. It happens. It's never pretty, for either side, but it happens. Where did you come from? I ask because hasn't there been a change of "ownership" of pretty much all cultures? I don't think this is retribution. It's a society that allowed billionaires.
The confirmed AG is thoroughly corrupt and Trump's buddy, that's why he chose her. So is the DC Acting US Atty. Many of the top career people have been fired (illegally). We don't know how those who are left will act, either lawyers or Marshals.
Trump put his foot on Congress with J6 and the Reserves that needed to back up the Capitol and Metropolitan police. He will put his foot on the Marshall service to execute court orders.
Thank you, John Roberts, for hastening a Taney level constitutional crisis. He was bad without immunity.
How would the order for #EloNazi to destroy any data he received from the Treasury payment system be enforced? How is enforcement of computer-technical orders done? Because someone has to follow the data.
Can any attorney tell me if states can enforce federal orders? If a fed judge orders Elon to disclose, he defies and is held in contempt, can a state police office take him into custody if the FBI won't?
Does this mean the U.S.A.G. has the power to refuse to order the U.S. marshals to arrest someone who violates a court order (even if that refusal contradicts a court order)? @weissmann11.bsky.social
Constitution must
be amended to take pardons, prosecutions, enforcement and investigation OUT of the executive branch and create a fourth independent branch of govt. After civil war II, I guess.

Are there any other legal options to enforcing the court’s ruling? Outside the box?
until Trump tells Bondi to
tell the Marshalls to
arrest Trump-Musk and gang.
Therefore, no decision need be made by any Marshall.
However, they absolutely will, and already have, because Trump believes he is the law and can get away with anything he chooses.
And as a matter of political reality and pragmatism, impossible.
Whoever he fires has an underling as an actor. And any replacement would need Senate confirmation.
Republicans aren't gonna confirm people who are "gonna disobey judges orders" lmfao.

They don't obey the AG, the DOJ, or anybody telling them to disobey a judge. They are Sheriffs, essentially, and they answer only to the Constitution.
Shame on her. Surrendering in advance, aiding the enemy.
