Last night, US Judge Sweeney in Colo granted district-wide (state-wide) class habeas TRO to stop Trump from summarily removing aliens under his Alien Enemies Act proclamation. @ACLU attys had warned that, despite SCOTUS ruling, Admin won't commit to providing even 24 hrs notice.

If Roberts cares for being remembered he should do something to fix this or be remembered as having dismembered SCOTUS. If the Constitution is destroyed, SCOTUS is no longer a thing.

The best thing for pundits to do is just explain that this is illegal and admin doesn’t have the authority to do it. Full stop. Explaining that maybe things are just different this time cedes power. Part of his strategy is the appearance of authority via narrative. Don’t give it to him.

SCOTUS cannot enforce its own decisions, it depends entirely on the Executive Branch to act. If the President, Attorney General, or other executive actors refuse to comply, enforcement may not occur. This can in turn trigger a constitutional crisis.

The only option I see is for them to threaten impeachment and removal of all that defy the ruling. Yes, they would have to convince Congress to do their jobs. But, a system of checks and balances will not work when one branch defies the other two.
