This nation is in bigger trouble than we’re already in if the Supreme Court rules in the administrations favor. Regardless of the outcome, Trump will ignore any order of the Court. There’s slim to no chance Mr. Garcia will be back in the U.S. tonight. Just my opinion.
Josh I so appreciate your role as town crier for the rest of us, and hope you also get some down time to ... idk, enjoy some flowers or sunsets or cute dogs too.
Its so stupid that DJT, Bondi, etc. throw their hands in the air about this - well it's a whooooole other country - what can we do? When they are so performative about their POWER - they want us to all see how good they are at getting people to bend to their whims. Such hypocrisy.
I'd like to say I'm popping the popcorn and waiting, but I feel like that undermines the importanxe of this singular moment. I mean, the only outcomes 1) he obeys, we have a shred of democracy we can claw back 2) he disobeys and heads roll to jail in contempt or 3)US democracy is dead and buried.
That he’s even there is despicable. An El Salvador prison guard said that the only way to leave this prison is in a coffin. They can now demand from Trump/USA millions (taxpayer💰) for his release b/c idiot Trump gave a terrorist gov’t total control of an innocent man. Many innocent, actually.
Absolutely. I think it's also important that the administration find out now that it will hold and they will be held responsible. Today could be a very important day for them.
How did Biden get Brittney Greiner back in good health from a hostile state, but trump can't get this guy back from a
small country he is in underhanded crooked criminal partnership with?
Hey trump: Where's your superior business skills, you fraudulent gargoyle?
The people who perpetrated this fiasco must be charged with kidnapping and more. If I or any other regular American took someone off the street and transported them to another country against their will, I'd be in deep shit. If no one is held accountable, there's no reason not to do it again.
But while also giving a clear roadmap to the government: just say you tried to “facilitate” his return, even if unsuccessful, and that will be good enough for me! (And, I expect, SCOTUS)
Now let’s see some states’ DA file charges directly against ICE agents for these illegal abductions, make their peers think twice about following orders.
Totally off-track, but this is a surprisingly common mistake: ""It takes no small amount of imagination to understand that this is a path of perfect lawlessness, one that courts cannot condone." No, it takes no "great" amount of imagination. See also "I can't overstate/understate," often wrong.
The scale of their blunder is that they put the absolute most sympathetic person in the gulag, but their ability to keep using the gulag depends on their claimed inability to get anyone out. So they are forced to fight on this hill, with the worst facts for them.
This thing where ICE is attempting to frustrate habeas petitions by playing shell games with detainees is bad enough, but the idea that *this* type of removal could in any way come close to being allowed to stand is nightmarish.
In various cases, judges appointed by just about every President since Ford (yes, I believe a judge appointed by Ford is still around) have told this DOJ that they are wrong.
I was just wondering if they've signed onto other recent briefs opposing matters of constitutional import, considering they're rather busy & there's a fair amount of ground to cover there.
The El Salvador dictator will not allow anyone out. Anyone returned will speak on the torture, abuse, murders and suicide. Rubio and Trump had to have been told and assured the dictator not to worry. I don't see this poor innocent man released!
He is a WITNESS TO THE CRIMES BY EL SALVADOR DICTATOR as ALL THE REST UNJUSTLY SENT THERE, AS I'VE SAID: RUBIO & TRUMP were advised that no one once there could be returned due to them SPEAKING ON THE HORRIBLE ABUSE, TORTURE, DEATH AND SUICIDES. I DOUBT THEY WILL BRING HIM BACK!
I mean, it's lawyers who are condemning and successfully challenging this; and whichever lawyers (if any) came up with it are incompetent and depraved. Ultimately the policy is a political decision.
No, because Boasburg provisionally certified a class. In theory his case can resolve the issue for all of the others renditioned to El Salvador under the Alien Enemy Act. (There is a further problem for those the admin claims were not sent pursuant to the AEA.)
Not necessarily, but this one is the easiest, as the government admitted that he shouldn't have been sent there. The other cases are going to be harder.
If there's any shred of humanity left, SCOTUS won't even take this up and they'll leave it be. There's no grey area here: "We took him, we fucked up and shouldn't, and you can't make us fix it" is not a legal argument that works. It's beyond debate. They don't want him back.
It seems completely defeating to have what appears to be NO consequences attached to court rulings w deadlines/orders that are ignored. I don't understand it.
Trump CAN NOT be allowed to ship American Citizens to a concentration camp overseas and just forgotten. He knows that if he wins this case, he can ship any dissenters his DOJ chooses to. At that point, the Constitution is meaningless, and we are no longer a Democracy.
Yep. And if they do ever get anyone out, we're going to get a first-hand emotional account of just how dire conditions are in there. And how many disappeared are just everyday humans who happened to have the wrong ethnicity in lawless a police state.
If SCOTUS upholds the ruling, this will be the first time Trump has gone against their decision. We’ve been a constitutional crisis like you said for sometime, but this will be the showdown.
Yes, thought not following the Emoluments Clause was a constitutional crisis - he’s done that in both terms, trying to end birth right citizenship? Meh?
Hatch Act? Meh?
60 Minutes investigation said 75% of them had ZERO criminal record and of 25% that might have criminal activity, about half of those were for trespass, shoplifting, etc.
The 10-15% that may be more serious offenders still deserve due process.
And then there’s ABC, with its standard small plans crash coverage and not a word about John Roberts’ cruel stay of the order to return the innocent Kilmar Abrego Garcia to the US. Disinformation by omission. And spinelessness.
This was great… until the felon administration ran to the Supreme Court and Roberts just issued a temporary stay on the order. It’s looking like the Supreme Court has gone full fascist on us.
Do not ever let the fake christians that voted for this wash the stench off.
This man will more than likely die in that prison unless there's some international intervention & I don't even think that's possible in a timely manner, if at all.
Am I wrong in thinking there's no actual recourse for holding the regime accountable? SCOTUS gave Trump immunity for, well, everything. If Bondi is held in contempt, can't Trump just pardon her? Congress won't act. Seens like there's no more "checks & balances." And no one returns from El Salvador.
Hopefully he is alive. He was sent back to a country he escaped because he feared for his safety. The prison he is in had over 300 people die of “natural causes” in the last year which is unheard of in a jail. In most countries people are sent to jail in hopes it reforms them. Not there.

The Constitutional Crisis we've all been waiting for!
Let's see how the up-to-now undefeated legal strategy of "Fuck you, make me," holds up.
Will share
“POTUS should be able to send anyone he likes to foreign prisons without any recourse, because reasons”
How about Andry Hernandez Romero, the gay makeup artist⁉️
The ONLY ones that deserve to be in a gulag are the MAGAts that broke the law and sent these people there.

Staying a stay of protection?
I'd love to read their ridiculous justification so I can laugh for the first time in a few weeks.
Now, what are they going to DO about it?

"It is out of our hands."

HIS scotus will have another decision to make...and, i think, quickly.
You call this a system of Justice?
Checks and balances are one thing.
But at some point you have to actually do something.
The law people are $milking$ everything they can get out of every fucking case. 🤷♂️
Unfuckingbelievable.
This will be the canary in the coal mine
I fought
I'm dying
I swore an oath
And it's gone
My life for nothing
You flaming anuses created this mess. Clean it up.
Today he's talking about sending American citizens to somewhere like El Salvador. That's us! This is not going to end.
Especially given that John Roberts (the worst American ever) has said that Trump can do whatever he wants as long as he says “official acts” after
If nothing happens, then what?
It seems completely defeating to have what appears to be NO consequences attached to court rulings w deadlines/orders that are ignored. I don't understand it.
The deal with El Salvador is a one-way ticket. And, they're terrified that people are about to find this out.

THIS IS UNPRECEDENTED WHERE TF DO WE EVEN GO
Oh yes, they may drag feet 😑- but protection of THEIR [3rd Branch] POWER is not a small thing to sober and majestically robed deciders-of-law
