They've always been fascist. There have been fascist federal judges on the bench for decades (Reagan and the Bushes stuffed the courts with them). The fascist movement in the US has basically been a legal movement at its core since the 1970s.
John Roberts's history of voter suppression goes back to his admiration of William Rehnquist.
Rehnquist was STRONGLY opposed to the Voting Rights Act of 1965. There is a persistent rumor that Rehnquist himself used to go to the polls & challenge/harass Democratic voters in Arizona in the early 60s.

I don't think Davis even has a law degree; his Federalist Society bio shows work as a policy advisor to Rick Perry (pause to chortle), and an investigator for Tom Coburn, a Senator from OK.
But he feels comfortable telling the Executive Branch, in a dispute with a co-equal branch -- the job of which is to say what the law is -- to roll its tanks right through the line, irrespective of the constitutional debris.

MvM was the 1803 case when we agreed to give the Supreme Court the final authority to decide what is Constitutional & what is not.
The SCt can decide anything they want, and tRUmp can simply ignore them.
Unless the Senate is willing to vote guilty at an impeachment trial, there is no punishment for tRUmp refusing to obey a SCt ruling.
They get real soft when they have to spend a few days in the jails they wanted built
