During an ongoing hearing, an attorney challenging DOGE's constitutionality makes her case for a judge to act quickly: According to WaPo's review of internal docs, "Phase 3" of staffing cuts begins on Wednesday, she notes.

Asked about 1,000s of federal employees being fired, a govt lawyer responds: "I have not been able to look into that independently or confirm that." Chutkan responds incredulously: "The firing of thousands of federal employees is not a small or common thing. You haven’t been able to confirm that?"

The Trump DOJ's lawyer says the states have no evidence that Elon Musk has "any formal or actual authority" over the government's actions. Judge Chutkan seems skeptical of that argument: "I think you stretch too far."

Judge Chutkan says she plans to rule on the request for a TRO in the case challenging DOGE's constitutionality within 24 hours. She also plans to set a schedule for the requested preliminary injunction. By the hearing's end, she still appeared skeptical of the TRO, without deciding.

This is Judge Chutkan expressing skepticism over a key government defense to the Appointments Clause challenge of DOGE and Elon Musk's authority, an issue of potentially more lasting significance than the current battle over the TRO. ⬇️
