obvsl this applies to Kavanaugh too who illegally assaulted vote-counting centers in Florida to prevent a presidential recount. For him to sit in judgement over Jan 6th defendants is for him to sit in judgement of his own actions during the 2001 election.

This, where is the full court press to try and protect our democracy? Even if it doesn’t work it gets those arguments to the public, keeps pressure on SCOTUS before ruling and makes court an election issue.

I can't remember anything specific, but I was there from the 1990 race (when he ran the racist "Hands" ad) up to the summer of 1994 when Rush Limbaugh and Newt Gingrich were on the rise, so there were *plenty* of opportunities to complain.

Why can't SCOTUS just declare that part of the Constitution to be a dead letter, like they did with the insurrection clause in the 14th? Surely someone could gin up a case (could even be hypothetical, these days!) and make up some facially absurd legal theory to justify it
