One of the reasons I stopped playing multi-player video games is that too many times I was sent “homework” (YouTube videos) to watch and memorize before we play. I won’t do that and as much as I occasionally like LO’D I won’t do that either.
Cliff notes version. She can have a hearing to remove him. She is the judge. But, he then has the right to an appeal all the way to the Supreme Court, which will take years. Meanwhile, he stays in office.
The gist was it can’t just be done with the stroke of a pen, there’d have to be a trial, for which rules would have to be written for, hochul would have to be present for all of it as the judge, and it could be endlessly appealed
(I mean, it's true that it can't be done literally with a stroke of a pen, but the process required by law is extremely minimal—the mayor must receive a copy of the charges against him and be given "an opportunity to be heard in his defense")
Yeah and apparently Lawrence is under the impression the Gov would have to act as the judge and prosecutor which does seem like a blatant flaw someone would’ve caught ahead of time, but politician’s have been more corrupt/stupid before and this is NY so it’s not impossible.
That doesn't make a lot of sense to me. Not all removal processes are equivalent to trials. The law just gives the governor the power to remove the mayor, as long as he's given the opportunity "to be heard in his own defense" (which could be a letter/brief).
She certainly implied during an earlier hour on msnbc that she could, and would consider doing it.
But I have not seen the latest hour on msnbc, so who knows?
That is what he said. He said she would need to be the only one prosecuting him and the only one judging him. Now that I say that I am not sure why that is an issue. Easy case. Oh and said they would be years of appeals so no point to it.
I didn't hear that Maddow segment, but it sounds like she's right and O'Donnell's wrong! (Which happens! Commentators sometimes get things wrong. But I think it's worth pointing out when they do.)
Her segment led us to believe Houchal could do something about it. I thought @lawrenceodonnell.msnbc.com gave us the details of the complexity should she choose to exercise her power. I feel Rachel is trying to hard to give us some hope in these times and thus over simplified the govs power.
No, it's really the opposite—Maddow's take sounds more accurate. The passage in the law is extremely brief and straightforward (see below), and while there isn't much precedent, what exists suggests simplicity (see link): https://case-law.vlex.com/vid/people-v-ahearn-886008678
On this, I agree, I'm not a New Yorker so I have to ask, does Adam's have that many democratic supporters? Does she really think the maga folks would support her?
Not really. FDR had the authority to remove mayor Walker but avoided direct action to prevent alienating Tammany Hall, a powerful political machine. Walker’s resignation effectively ended his tenure as mayor
Maybe, but there isn't much legal basis for challenges, certainly not federal. The statute is very straightforward, and the process has been used for other roles—e.g., Manhattan borough president
Lawrence explained that it is a never tried legal power, would def be appealed AND she cannot access any of the criminal evidence from the SDNY…. So he questioned how would that stand up at appeal? That was the synopsis.
It takes a certain level of lazy narcissism to expect blind belief from total strangers. But they’re right that they can’t explain it - they literally can’t if they don’t know what the hell they’re talking about in the first place.
'go watch last night's episode of MSNBC...I can't explain it' = a photogenic person with an authorative voice on television said it so it must be true.
No, no, no, Jeff. Like tRump gave Zelinskyy one hour to sign over half his country's rare earth minerals to the US. For such a paltry thing like the truth, I'd say 10 minutes.
I forget the original tweet but it was something like "I've only known you for a few minutes and enjoyed none of them. I'm certainly not going to do homework for you"
Time for everyone to start being direct & blunt, especially the media and our House & Senate members. Time for plain talk to explain what is happening. It is a Musk/Trump coup, fully out in the open. They are overthrowing the United States of America; it is a Coup, a Constitutional Crisis.
The governor of New York has the authority to remove the mayor of New York City. This process requires the governor to present formal charges to the mayor, provide an opportunity for defense, and potentially suspend the mayor for up to 30 days during the proceedings.
