It's section 23 para. 1 of the alien enemies act where it explains how people apprehended through this act are to appear in the court of their jurisdiction to make sure the order is appropriate. In other words, due process. Not just for "citizens" rather, for "residents".

I want "punishment" too but a "pardon" pardons the conviction - they were still convicted.
Getting a pardon because you're the president, who has 34 felony convictions and still got elected, and can pardon yourself is beside the point for me.
