J6 prosecutions leading the conservative brainworm vortex to consider the unpleasant experience of criminal process for the first time in human history such that when they regain power they issue just. insane and incoherent reform proposals.
literally the suggestion offered by an eager but unreflective and not overbright sophomore in the first discussion session of the class where prosecutorial discretion was described for the very first time.
I am genuinely experiencing the TA urge to say “that’s a really interesting suggestion, does anyone else in the class have some thoughts about what consequences we might see”
A bunch of the J6ers whine that they were unjustly coerced into taking guilty pleas on lesser charges in order to avoid substantial time on more serious ones. So now plea bargaining is bad.
Well after this strong start, how could it go downhill: “The Department of Justice is the only federal agency with a name that includes a moral imperative: to do justice.”
I was ready to charge her with being a fucking idiot but plea her down to just being intellectually lazy, but I guess my original charge has to stand now
Sen. Whitehouse re Bondi on All In W/ Chris Hayes Feb 4 after she was confirmed. Said that there's a lot to admire & like about her but in the hearings when you got near "Trump sensitive areas" it's like a plane flying into Bermuda Triangle, all navs & comms go haywire. (audio won't upload here)
I'm guessing nonsense like this is designed to give them an excuse to say the charges against Trump were illegal, and therefore the people involved broke the law and must be charged and convicted. Can't think why else they'd do it other than working towards authoritarian pseudojustice.
Ironically (or unintentionally?), this is actually responsive to a common leftist criticism of prosecutors, which is that they stack charges in the hope of leveraging defendants to plead guilty to lesser crimes.
The people who will hate this the most are defense attorneys. It's a lot tougher to sell your client on "you should just plead guilty to everything you're charged with and maybe hope for leniency" than it is to sell them on a meaningful reduction in their charges.
Right, this memo does away with the practice of including "plea fodder" in an indictment, which ultimately allows for the "bargaining" part of a plea bargain. It does not allow for cooperation against more culpable offenders. It's so counterproductive.
Basically all of it, except they do take an oath to support the Constitution. They are still subject to all the ethical obligations of the states where they are licensed. You don't get your license to practice from the federal government.
Any of the trump prosecutions. The fake elector schemes resulted in waves of plea deals. The circus of a case in georgia. New york. The trump org fraud case. All used plea deals of lower level employees to get to trump. He’s a mob boss, he needs to prevent flipping. He’s all about loyalty.
The political right heard that some J6 defendants received reduced charges in exchange for guilty pleas, and assumed they were the first people in history to be treated in such a way.

DEFENDANT: I don't care for the hostile tone of this so-called "indictment" and if you keep it up so help me I will call Pam Bondi myself and tell her you're violating policy
So, Bondi concluded that there was improper weaponization of DOJ before conducting her investigation into the federal and state charges against T because T said so in EOs?
"You're looking at 10 felony counts and 20 years. To avoid a trial, our offer is this: plead guilty to 10 felony counts and serve 20 years. That said, please be assured there's no animosity here! I'm sure the targets of your interstate bombing campaign deserved it. Can I get you a latte?"

It soulds as if they're preparing to railroad folks through a specific process intended to arrest, indict, convict, and incarcerate at speed.
At a guess: kettled, arrested protestors are going to be in for a ride.

The Garland Memo
I'd guess it stems from members of Oath Keepers and Proud Boys who got plea deals for testifying against Rhodes and Tarrio
They thought they cooked with that one.
Like, the Oath Keeper plea deals?
have NO POWER OR AUTHORITY
over FEDERAL Prosecutors
their oath is to the Constitution

I know, we're in hypothetical land imagining Trump Admin will ever hold companies accountable for anything; but humor me.
