I don’t think so. The court ordered Ezell to *either* sit for a deposition or appear for live testimony. So the allowance in the order that there may not be any live testimony would appear to contemplate a deposition and then the transcript being introduced, not simply him doing neither.

True. But individual DOJ lawyers have already withdrawn or resigned rather than file unethical stuff. That's a tough personal choice, but better for your future than doing the dirty.
