When using force, you must first try to deescalate the situation, & do nothing to escalate the issue. When Penny attacked, he merely believed Neely would attack. At that time, Neely had merely been yelling, & had not even interacted with Penny. Plus he didn't let up after Neely was incapacitated

The DA knew it was not murder and did not even attempt to charge him with murder. They tried for manslaughter which the jury could not agree on. DA then dropped the manslaughter charge and ultimately acquitted of the lesser charge- criminally negligent homicide.
