Judge Xinis is talking to Ensign now, asking what he would take away from the Oval Office meeting yesterday. Xinis doesn't think it counts as evidence. Ensign says he shows position of El Salvador...they don't want to release "terrorists"

If the courts are a co-equal branch of government it is time to start acting like it.
Xinis: We're gonna do this by rule of civil procedure. Press conference won't do. We're gonna do interrogatories...follow rules...
Ensign: Transcript of oval office meeting sets forth evidence consistent w/ federal rules of civil procedure..
And 2 weeks is plenty of time for them (you know who) to muck up the works for good.
We’re talking about due process, and whether we like it or not, both sides are afforded due process. There’s no picking and choosing.
If Garcia is owed due process, then so it DOJ
Yes, we know. But you can’t respond to Garcia not getting due process and argue how important due process is…then turn around and deny the other side.
Two wrongs do not make it right.
You also quoted the Fifth, with emphasis on PERSON. You are 100% correct, and Drew Ensign is a person. If contempt is in his future, he gets due process.
A judge. Not Trump.
1. They maintain they have no power to bring him back, but now concede just maybe they do?
2. Slippery words here: if he presented at border, he'd again be removed "after withholding of removal removed" - so he would get due process but resilt is a foregone conclusion?
Thank you.😎🎶

Ensign: If he presents at port of entry or embassy, he would be taken into US custody...this is narrow issue of what "facilitate" means
Xinis: I disagree, and I'm prepared to issue order on what facilitate means..
It is clear in the constitution that no person shall be denied Due Process.
NO PERSON!
Ensign be like
In light of that fact that SCOTUS did not clarify what facilitate means, hence the state of confusion we now endure, Xinis is showing a little leadership here.
Xinis: Bring him into this courtroom and present him to me by noon tomorrow or you will go to jail.
facilitate
1) to make easier or less difficult; help forward (an action, a process, etc.): Careful planning facilitates any kind of work.
2) to assist the progress of (a person).
Justice Roberts, this is what a spine sounds like.
then trial continues
even at an accelerated pace, it'll be a month then appeals... yadda yadda yadda

HAPPENING NOW: At the federal courthouse in Greenbelt, Maryland, Judge Paula #Xinis is set to begin a hearing on the government’s efforts – or lack thereof – to “facilitate” the return of #KilmarAbregoGarcia , a Maryland resident who was wrongly...
Then do the two weeks of discovery and discussion while he is in this country with his family, and he can appear in the courtroom.
This is absurd...our justice system needs to be overhauled.
Get it on record
Like, that is the only option?
No one has power to override this?
It's bullshit. They have no intention of complying.

Trump: I loveSCOTUS
Damn these evil thugs
Trump is now dictator and there's nothing that can be done.
All those checks and balances: for nothing when we needed them.
(Not so much for Osama Bin Laden, but fuck that guy.)
Now
He tries to be tough & forceful, but Judge Xinis bitch slaps him back every time.
They just don’t want him to tell his story.
He’s either seen torture, or been tortured, and they don’t want the American public to know that’s what Hitler, I mean Trump told them to do.
I’m getting the feeling, for all the noise they made about “ALL people matter,” they never meant it.
I think they don’t want Mr. Garcia coming home and telling the story of what is really going on in that prison.
My guess is he gave evidence to the Feds under Biden and now Trump has just fed him to the piranhas.
Hearing now in progress. Ok, let's get serious - I need another 2 weeks to see if I hold you in contempt.
I’m beyond sick & tired of these Federal Judges pussy footing around where Trump’s outright defiance of their Court Orders is concerned.
For Pete’s sake, have some balls.
Two weeks may be required, but I stand by first statement: two weeks is two weeks too long.
She's required to give them two weeks notice of a hearing
There have been rumors of threats against Republican congressmen to ensure they stay in line. Both threats of primary (Elon) and rumors of violence
Shoulda jailed all the Proud Boys.. & others
Not saying it's the same, but 2 weeks is an eternity for anyone in a terrible situation like that.
It's so utterly typical.
Is this all a show?
Is there no humanity left?
That's the key 𝑢𝑛𝑎𝑛𝑖𝑚𝑜𝑢𝑠 SCOTUS order that sometimes gets lost in the semantic distraction of "effectuate" vs. "facilitate."
IT'S NOT HARD TO DO THAT, AND OF COURSE BUKELE WOULD COMPLY.
Anything short of that is contempt.
Bukele said he didn't have the "power" to return him ("smuggle a terrorist"): he doesn't need power to return him. He needs permission. Trump can do that.
The finding would be civil contempt (which can't be pardoned, by the way), because the goal is to get the administration to obey the order.
She can send somebody to jail. She's trying to establish who the best person to send to jail is.
But she can jail *somebody* until Garcia
Bondi? Noem?
When Garcia is returned, would the "jail sentence" end in this scenario?
I mean good luck getting that contempt finding/order though.
A judge can hold you in contempt, call you in for a hearing, and potentially jail you until you pay up.
Lawyers who lie should face discipline.
