Among the items that Ruby Freeman & Wandrea' Moss now control is Mr. Giuliani's claim against Donald Trump for $2 million for legal work done after the 2020 election.
This may lead to the turnover of attorney-client communications. It's complicated, but fee disputes are a privilege exception.
As dumb as they are, both Giuliani and Trump are both opposed to note taking. Also, neither speaks in coherent sentences, so I’m tempering my hopes about what can be learned here.
All I need to be happy in this fucked world is to read daily about something Rudy has turned over to those two women. That's all. If he has a clean pair of boxers, he better be stuffing them in an envelope. Half a bottle of aspirin? That goes, too.
Here is some further explanation. Under NY law (Rule of Professional Conduct 1.6), "a lawyer may reveal or use confidential information to the extent that the lawyer reasonably believes necessary . . . to establish or collect a fee."
. . . make certain that "a disclosure adverse to the client's interest shall be no greater than the lawyer reasonably believes necessary to accomplish the purpose."
Here, Ms. Shea & Ms. Moss have been given control of Giuliani's claim against Trump for a $2M fee.
They should be able to get all of the documents from Mr. Giuliani establishing the entitlement to that fee, including all documents on the work done by Mr. Giuliani.
They would, however, likely be required to keep those documents confidential, unless a court ruled that their public disclosure . .
. . . was required to establish the entitlement to the $2 million fee.
There is one other huge exception to the duty to keep the attorney-client communications confidential -- the crime-fraud exception. If the communications between Trump & Giuliani were to commit a "crime" or to inflict a . . .
. . . "fraud" on the courts, they would not be privileged at all and could be publicly revealed.
Once the highly capable attorneys for Ms. Shea and Ms. Moss have the documents, I would not be surprised if they became public - one way or another. This likely won't happen before the election. -30-
is there caselaw on a third party stepping into the shoes of the atty to press the claim? this feels like something that wouldn't be allowed either by ethics rules (claimant is not the lawyer) or some carveout in bankruptcy law (some bar against recovery requiring state-licensed services of debtor).

I want to see a followup story of Ruby and Shay once they have actually received money and no longer owe lawyers, etc. I hope to see them bright and happy. They do need to carefully hire a good quality financial advisor.
