Acting deputy attorney general Emil Bove assembled DOJ's remaining public corruption prosecutors this morning and gave them an hour to find someone to sign the Eric Adams dismissal.
One of them agreed to do it, to spare the others from potentially being fired.
It's now 5 p.m., four days after the department's leadership ordered prosecutors to drop the Eric Adams case. Nobody has filed the motion to dismiss, or filed a notice of appearance on the docket.
Of course in the process of trying to protect himself he has not only exposed himself further but opened himself up to criminal obstruction of justice charges.
I’d love to see the judge questioning Bove about the “negotiations” with Adam’s defense counsel preceding this dismissal— if he’s crazy enough to sign this himself.

Judge Ho is going to go nuclear. He can't force the trial to happen. But when the corrupt official signs the corrupt motion, and there's a paper trail explaining how that very same official orchestrared it, a good juge will have a stinging response.

Exactly. Not a lawyer, but I'm wondering if the judge could (a) immediately ask tough questions along the lines of "was this the result of any sort of illegal/unethical quid pro quo?" and/or (b) refuse to accept the dismissal without a hearing to ask those same questions and get answers under oath.

Not a crim pro expert but I think an indictment can only be dismissed with leave of court. So the Judge can certianly deny leave. Someone smarter than me will have to explain what would happen then.
Yeah. Tactically speaking, it probably doesn't matter much because at the end of the day, Ho is probably not going to dismiss the case, but DOJ isn't going to continue prosecuting. So at this point the concerns are purely political.

To some extent, judges (and juries) still have that power. But dropping charges is different: there needs to be somebody at DOJ who is willing to pursue the case.

I have been corrected that a judge can certainly refuse to accept the motion to dismiss — don’t know the consequences of that refusal or how the case would be prosecuted by a corrupt DOJ afterwards. 1/2
2/2 I also learned that the judge can also require a kind of evidentiary hearing with witnesses, a mini trial, about how the charges came to be and other details. Either way, this fiasco of corruptness is and will damage the DOJ forever.

This is a motion to dismiss, not a notice of dismissal. The judge has some discretion here, maybe not a lot, but enough to require the attorneys and parties to appear in court for a hearing. And the judge certainly has the right to ask questions.

Oh that’s odd. I assumed each state got their code of ethics from the one set by ABA listed on their website. Maybe it’s just a guideline that each state bar association works from. It seems odd otherwise.

This is a motion to dismiss, not a notice of dismissal. The judge has some discretion here, maybe not a lot, but enough to require the attorneys and parties to appear in court for a hearing. And the judge certainly has the right to ask questions.
